Welcome to Pinoy Asian Market. In these Terms and Conditions (“Terms”), “we,” “us,” and “our” refer to Pinoy Asian Market. We operate this online store and its related content, products, tools, and services (the “Services”). Our store is powered by Shopify, which provides the technology that enables us to offer the Services.

These Terms, together with the policies referenced below, explain the conditions for using our Services. Please read them carefully, including the warranty disclaimer and limitation of liability. By accessing or using the Services, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, please do not use the Services.

Acceptance of Terms

You must be of legal age to enter into a contract in your place of residence or use the Services with the consent and supervision of a parent or legal guardian. You agree to provide accurate information, use the Services lawfully, and not interfere with their security or operation, infringe others’ rights, or submit fraudulent orders.

Products and Information

We offer everyday household items, including products for storage, cleaning, kitchens, and other practical needs. We aim to describe items clearly, but photographs and screen settings may affect how colors appear, and dimensions may vary slightly. Product availability and descriptions can change. If we discover an error, we may correct it and contact you where appropriate. Your rights under applicable law are not affected.

Order Acceptance

After you submit an order, an acknowledgment may confirm that we received it; it does not necessarily mean that we have accepted it. We may decline or cancel an order for reasons such as unavailability, pricing errors, suspected fraud, or an inability to process payment. If we cancel an order after payment has been collected, we will refund the amount paid for the canceled items. We may contact you using the details provided at checkout.

Pricing and Payment

Prices are displayed in U.S. dollars and may change before you place an order. Applicable taxes and the order total are shown at checkout. You agree to provide current and accurate billing and payment information. Available payment methods are shown at checkout and depend on the payment providers enabled for the store. Shipping Policy

We ship within the United States with free shipping. Orders are generally processed in 1–3 business days and delivered in 3–5 business days after shipment via UPS. The order cutoff is 2:00 PM Pacific Time. Business days are Monday through Friday, excluding U.S. federal holidays. Delivery estimates are not guarantees. Returns, Exchanges and Refunds

Return or exchange requests must be made within 30 days of delivery. Items should be unused, unwashed, and in their original condition and packaging, subject to applicable law. If an item is damaged, defective, or incorrect, contact us so we can help; we cover reasonable return shipping in those cases. For a change of mind, the customer pays return shipping. There is no restocking fee, and replacement shipments within the United States are free. After receiving and inspecting a return, we generally process an approved refund to the original payment method within 5 business days; the payment provider may take an additional 5–10 business days to post it. To cancel an order, contact us promptly before it ships. If we confirm it has not shipped, we will cancel it and issue a full refund without an additional handling fee. Once shipped, the return and refund process applies.

Intellectual Property

The Services and their content may be protected by copyright, trademark, and other intellectual property laws and belong to their respective rights holders. You may use the Services for personal, noncommercial shopping. You may not reproduce, distribute, modify, or commercially exploit protected content without the relevant rights holder’s permission, except as permitted by law.

Disclaimer of Warranties

To the extent permitted by applicable law, the Services are provided on an “as available” and “as is” basis, without warranties of uninterrupted or error-free operation. We disclaim implied warranties to the extent legally permitted. Nothing in these Terms limits a warranty or consumer right that cannot lawfully be excluded.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PINOY ASIAN MARKET, SHOPIFY, AND THEIR RESPECTIVE AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS, INCLUDING LOST PROFITS, REVENUE, SAVINGS, OR DATA, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO THESE LIMITATIONS APPLY ONLY TO THE EXTENT PERMITTED BY LAW. NOTHING IN THESE TERMS EXCLUDES LIABILITY OR CONSUMER RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED.

Termination

We may suspend or terminate access to the Services where appropriate, including for violations of these Terms, suspected fraud, or security concerns, subject to applicable law. You remain responsible for amounts properly due before termination. Provisions that by their nature should continue, including those concerning intellectual property, disclaimers, limitation of liability, indemnification, and governing law, survive termination. Termination does not affect rights that cannot be waived under applicable law.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Pinoy Asian Market, Shopify, and their respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers against third-party claims, losses, and reasonable legal fees arising from your breach of these Terms, violation of law, or infringement of another person’s rights in connection with your use of the Services. This obligation does not extend to losses caused by an indemnified party’s own negligence or misconduct where prohibited by law.

We will notify you of an indemnifiable claim; delayed notice will not relieve your obligations unless it materially prejudices your ability to defend the claim. We may control the defense with counsel of our choice at your expense where permitted by law. You agree to cooperate reasonably, including by providing relevant information. We will not agree to a settlement that imposes non-monetary obligations on you without your consent, which will not be unreasonably withheld.

Governing Law

These Terms are governed by the laws of the State of Texas and applicable United States federal law, without limiting any mandatory consumer protections that apply in your place of residence.

Changes to These Terms

We may update these Terms by posting a revised version on this page and will provide additional notice when required by law. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms. Orders already placed remain subject to the terms applicable when they were placed, except where a change is required by law.
